Terms of service

1. The service

SpoorFox is a software platform for website analytics, behavior analytics, revenue attribution, paid media management, social media management, account intelligence and AI assistance. Each customer receives a private SpoorFox environment hosted in the European Union. The modules, limits and prices of each plan are described on the pricing page and in your order.

2. Accounts and access

You are responsible for the users you invite, for keeping credentials safe and for activity under your accounts. You must not use the service to break the law, to infringe the rights of others, to send unsolicited messages or to attempt to access data or systems you are not authorized to access.

3. Trial

A trial runs for 14 days unless agreed otherwise. To continue after the trial you add a payment method or agree to pay by invoice. If you do not, the subscription ends when the trial ends and nothing is charged.

4. Subscription, prices and payment

• Subscriptions are billed monthly or annually in advance, in euros. Prices exclude VAT, which is added where applicable.
• Payment is by card, charged automatically at the start of each billing period, or by invoice with 30 day payment terms where agreed.
• Payments are processed by Stripe. We do not store your full card details.
• Plan changes take effect immediately and are prorated on the next invoice.
• AI credit packs are one-off purchases. Credits are available once the invoice is paid and remain valid for twelve months after your last purchase.
• We may change prices with at least 30 days notice before your next renewal.

5. Late payment

If a payment fails or an invoice is overdue, we notify you and retry. After 14 days without payment the service may be limited to read only access. After 30 days without payment we may end the subscription and remove your environment as described in section 8. Paying the outstanding amount before then restores full access.

6. Term and cancellation

Subscriptions renew automatically for the same period. You can cancel at any time with effect from the end of the current billing period. See the cancellation and refund policy.

7. Your data

You own the data you and your visitors put into SpoorFox. We process personal data on your behalf as a processor under our data processing agreement, and only to provide the service. You are responsible for having a legal basis, for informing your website visitors and for obtaining consent where required, including for session recording. See the privacy policy.

8. End of the service

When a subscription ends you can export your data until the end date. After the end date we remove your environment. A final backup is kept for 90 days so that we can restore it at your request, and is then deleted.

9. Third party platforms

When you connect ad accounts, social profiles or other platforms, their own terms apply to your use of them. Changes to ad accounts and social profiles are only made after approval by a user in your workspace. You remain responsible for your ad spend and published content.

10. Availability and support

We work to keep the service available and to announce planned maintenance in advance. Support is provided by email at support@spoorfox.com on Dutch business days.

11. Liability

Our total liability for any claim related to the service is limited to the fees you paid in the twelve months before the event that caused the claim. We are not liable for indirect or consequential loss, lost profit or lost data, except where the law does not allow this limitation, such as in case of intent or gross negligence.

12. Changes to these terms

We may update these terms. Material changes are announced at least 30 days before they apply. The version on this page applies from its date.

13. Governing law

These terms are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands.
